Name & Gender Marker Changes

Legally changing one’s name and gender marker are important steps in the gender affirmation process of many transgender and non-binary people. We will walk you through the process and advocate for sealing of court documents and waiver of publication requirements so that your right to privacy isn’t compromised. We will also work to change your name and gender marker on your birth certificate and other legal documents.

If you identify as a member of the LGBTQ community you may face daily or systemic discrimination, bullying, and legal challenges. Attorney Michael Poreda has extensive experience litigating for LGBTQ students and workers alike who are struggling with issues around sexual orientation, gender identity, gender markers, and gender expression. He is licensed in both New Jersey and New York.

Bullying & Discrimination at School

LGBTQ students are protected by state law. They have the right to be free from harassment, intimidation, and bullying (HIB), and the right to use the restrooms and locker rooms that match their gender identity. We represent students when schools do meet their legal obligations to investigate and respond to HIB or do not fully accommodate trans students. When administrative remedies are insufficient we litigate for students who are victims of discrimination on the basis of their LGBTQ status.

Workplace Discrimination

State law protects workers on the basis of actual or perceived sexual orientation and gender identity/expression. The law also protects workers who speak up about discrimination against LGBTQ employees. We fight employers who discriminate, retaliate, or create a hostile work environment based on any employee’s actual or perceived LGBTQ status and gender expression.
