Expungement - Marijuana Offenses

New Jersey Assembly Bill No. 5981 was just signed into law by Governor Phil Murphy.

Pursuant to this bill, offenses for distribution or possession with intent to distribute marijuana or hash are now considered disorderly persons offense and can be expunged five years after the conviction has ended or completion of probation if the person meets the requirements of the Expungement Statute. Previously, these charges could not be expunged.

Convictions for possession of marijuana and related paraphernalia are no longer considered criminal offenses and therefore these arrests and convictions can be immediately expunged if the person satisfies the rest of the requirements of the New Jersey Expungement Statute.

If you think you may be eligible for an expungement of any case involving marijuana and hashish, whether charging distribution or possession and whether resolved by a dismissal, or guilty please or diversionary program such as Pre-Trial Intervention (PTI) or conditional discharge, please call our experienced expungement attorney Kevin Hewitt.
