As reported in NJ.com, a Federal Court has ruled that a New Jersey man can recover $931,000 from a woman who he briefly dated, in a long-distance relationship. The woman was from Oregon. After the relationship ended, she posted online nude images and videos of him that he had sent to her. In addition, she contacted his work and sent text messages to family members as well as called his new girlfriend.

Two videos and 12 images of S.S. intimate body parts and videos of him engaging in sexual acts were shared over 77 times through anonymous text messages during a three-week period.

The ex-girlfriend even went so far as to create a phony Facebook profile alleging to be S.S., posted the graphic images and included a Craigslist ad that included his social security number, phone number and date of birth, court documents show.

The Court awarded him $1,000 for each of the 77 times graphic content was allegedly shared by the woman, $150,000 in liquidated damages, and another $681,000 in punitive damages.

The lesson to be learned is to be very careful when you transmit sexual images of yourself online.

In addition, it is illegal in New Jersey to transmit images or videos of anyone engaging in sexual activities, without express permission. This is true even if the individual consented to being filmed performing sexual activity. You can be charged with Invasion of Privacy under NJSA 2C:14-9 (also known as Revenge Porn) or Cyber Harassment under NJSA 2C:33-4.1. Both offenses can result in prison sentences.
