Invasion of Privacy

According to NJ.com and mycentraljersey.com a New Providence man has been arrested and charged with using his cell phone to secretly record his teenage stepdaughter in the bathroom of their home.

 

Police said the girl found the cell phone under items of laundry.  It was able to record the bathroom. 

 

Invasion of privacy under N.J.S.A 2C:14-9 is a crime of the fourth degree if, knowing that he is not licensed or privileged to do so, under circumstances in which a reasonable person would know that another may expose intimate parts or may engage in a sexual penetration or sexual contact, he observes another person without that person’s consent and under circumstances in which a reasonable person would not expect to be observed.

 

An actor commits a crime of the third degree (three to five years New Jersey State Prison) if, he photographs, films, videotapes, records, or otherwise reproduces in any manner, the image of another person whose intimate parts are exposed or who id engaged in an act of sexual penetration or sexual contact without that person’s consent and under circumstances in which a reasonable person would not expect to be observed.

 

If the individual charged recorded people or the young girl going to the bathroom, he would be guilty of this offense.

 

In addition, if the person photographed or video taped was under the age of 18, the defendant would also be charged with Endangering the Welfare of a minor contrary to N.J.S.A. 2C:24-4.
